Nothing contained in the App constitutes medical advice, diagnosis or treatment. No doctor–patient, therapist–client, nutritionist–client or healthcare provider relationship is created by use of the App.
If you are experiencing health concerns, disordered eating, addiction concerns or crisis situations, you should consult a qualified healthcare professional immediately.
The App is not a substitute for professional treatment.
Behavioral and Dietary Disclaimer
The PROCSD App addresses topics related to ultra-processed food consumption, compulsive eating behaviors and habit change. These topics may involve sensitive personal, emotional or psychological issues.
You acknowledge and agree that:
Individual Results Vary — Dietary change, habit modification and addiction recovery are highly individualized processes. The App does not guarantee any particular results including abstinence from ultra-processed food, weight change, health improvement or psychological benefit.
Risk of Emotional Distress — Tracking behaviors, viewing streak data, logging relapses or engaging with habit-tracking tools may cause emotional reactions including stress, anxiety, frustration, guilt or disappointment. Such reactions are a normal possibility when engaging with habit-tracking tools.
Not a Clinical Program — PROCSD does not provide addiction treatment, dietary therapy, behavioral therapy or psychological counseling. The App is not intended to replace professional care for addiction, disordered eating, compulsive behavior or mental health conditions.
User Responsibility for Decisions — Users remain solely responsible for their personal decisions, actions and behavioral choices. Any decisions regarding dietary change, health interventions or lifestyle changes should be made independently or in consultation with qualified professionals.
No Monitoring of User Behavior — PROCSD does not monitor or verify user behavior outside the App and cannot confirm whether behavioral goals are met.
Release of Behavioral Harm Claims — To the maximum extent permitted by law, you agree that PROCSD shall not be liable for any claims arising from relapse or inability to change dietary habits, emotional distress related to habit tracking, health outcomes associated with use of the App, or reliance on App insights, streak metrics or behavioral tracking tools.
If you experience severe distress, disordered eating concerns or addiction symptoms, you should seek assistance from a qualified healthcare professional.
1. Eligibility
You must be at least 13 years old or the age of digital consent in your jurisdiction to use the App. If you are under the age of 18, you represent that a parent or guardian has reviewed these Terms. PROCSD reserves the right to suspend or terminate accounts where age requirements are not met.
2. Account Registration and Security
To access certain features, you are required to create an account using Apple Sign In or Google Sign In. You agree to provide accurate information, maintain the security of your credentials and promptly notify us of unauthorized access. You are solely responsible for all activity occurring under your account. PROCSD is not responsible for losses caused by unauthorized account access.
3. License to Use the App
Subject to compliance with these Terms, PROCSD grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the App solely for personal, non-commercial purposes. No other rights are granted. All rights not expressly granted are reserved by PROCSD.
4. Intellectual Property Ownership
The App and all related technology, including but not limited to the software, algorithms, databases, designs, graphics, text, branding, trademarks, logos, user interface elements, analytics systems, habit-tracking models and progress tracking algorithms are and shall remain the exclusive property of PROCSD or its licensors and are protected by applicable intellectual property laws.
5. Intellectual Property Restrictions
You may not directly or indirectly copy, reproduce, modify, distribute, sell, license or create derivative works of the App; reverse engineer, decompile or disassemble any portion of the App; attempt to extract source code, algorithms or data models; scrape, harvest or collect data from the App; use automated bots, crawlers, spiders or scraping tools; mirror or frame the App on another service; use the App to build a competing product or service; use the App or its content to train machine learning or artificial intelligence systems; attempt to access non-public APIs or infrastructure; probe, scan or test the vulnerability of our systems; or bypass or attempt to bypass security protections or rate limits.
Any unauthorized use may result in termination of access, legal action, damages claims and injunctive relief.
6. AI Training and Data Extraction Prohibition
You may not use the App, its content, data, functionality or underlying technology to train, develop, fine-tune or improve any artificial intelligence, machine learning or large language model systems without the prior express written consent of PROCSD.
Users may not scrape, extract, collect, download or otherwise obtain data, content or information from the App for the purpose of training, validating, benchmarking or developing any machine learning or artificial intelligence models.
PROCSD reserves the right to pursue all available legal remedies for violations of this section.
7. Protection of Platform Integrity
PROCSD takes the protection of its platform, systems, data and intellectual property seriously. Any unauthorized access to, use of or interference with the App, its infrastructure, its data or its underlying technology is strictly prohibited.
PROCSD reserves the right to investigate and take appropriate action against any individual or entity that engages in unauthorized scraping or data extraction, attempts to access restricted systems, reverse engineering of proprietary technology, circumvention of security controls or rate limits, or attempts to disrupt or degrade platform performance.
Where such conduct is identified, PROCSD may immediately suspend or terminate access, block devices or accounts, preserve forensic evidence, cooperate with law enforcement and pursue civil claims including damages and injunctive relief.
8. User Content
The App allows you to create content such as journal entries, My Why text, progress logs and daily activity completions. You retain ownership of your content. By submitting content through the App, you grant PROCSD a worldwide, non-exclusive, royalty-free license to store, process and transmit such content solely for the purpose of operating, maintaining and improving the App. You represent and warrant that you have the legal right to submit such content and that doing so does not violate the rights of any third party.
9. Prohibited Conduct
You agree not to violate any applicable laws; harass, threaten or abuse other users; upload, post or transmit illegal, harmful or unlawful content; impersonate any person or entity; exploit the App for commercial purposes without authorization; attempt to bypass or interfere with App systems; use the App for spam or unsolicited communications; or interfere with or disrupt the functionality of the App or its services.
PROCSD reserves the right in its sole discretion to remove content, restrict access or terminate accounts that violate these provisions.
10. Subscriptions and Billing
Certain features of the App require a paid subscription. Subscriptions are purchased through the Apple App Store. Payment processing and billing terms are governed by Apple and RevenueCat. All fees are non-refundable except where required by applicable law. PROCSD reserves the right to modify subscription pricing or billing terms with reasonable notice.
11. AI Coaching Feature
The App includes an AI coaching feature called Sage, powered by Anthropic's Claude API. Sage is provided for informational and motivational purposes only and does not constitute medical, nutritional, psychological or professional advice. Responses generated by Sage are automated and may not always be accurate or appropriate for your specific situation. You should not rely on Sage as a substitute for professional advice. PROCSD is not responsible for any decisions made based on Sage's responses.
12. Beta Features
From time to time, PROCSD may release experimental or beta features. These features may be unstable, may change or be discontinued at any time and may contain errors or bugs. Such features are provided on an "as is" basis without any warranties of any kind.
13. Third-Party Services
The App integrates with third-party services including Supabase, RevenueCat, Apple App Store, Anthropic, Mixpanel and Adjust. PROCSD is not responsible for any third-party content, policies or data practices associated with those services. Your use of any third-party services is governed solely by the terms and policies of the applicable third-party provider.
If the App is downloaded from the Apple App Store, you acknowledge that these Terms are between you and PROCSD, not Apple Inc., and Apple has no responsibility for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL RELATED CONTENT, FEATURES AND SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." PROCSD DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY AND UNINTERRUPTED, SECURE OR ERROR-FREE SERVICE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROCSD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO EMOTIONAL DISTRESS, DIETARY OR HEALTH-RELATED HARMS, LOSS OF DATA OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO THE USE OF THE APP OR THESE TERMS.
In no event shall PROCSD's total cumulative liability for any and all claims arising from or related to the App exceed the greater of one hundred euros (€100 EUR) or the total amount paid by you to PROCSD in the twelve months preceding the event giving rise to the claim.
16. Indemnification
You agree to indemnify, defend and hold harmless PROCSD and its affiliates, officers, directors, employees, agents, licensors, service providers, successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, any content you submit through the App or your violation of any law or the rights of any third party.
17. Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the competent courts of the Netherlands, in accordance with Dutch law and applicable European Union regulations including GDPR.
Nothing in this section limits your rights as a consumer under applicable EU or Dutch consumer protection law.
18. Termination
PROCSD may suspend, restrict or terminate your access to the App at any time, with or without notice, if you violate these Terms, misuse the App or its services, or engage in conduct that creates legal, security or reputational risk.
19. Changes to the App
PROCSD reserves the right to modify features, discontinue services, change pricing or update functionality of the App at any time, with or without notice, subject to applicable law.
20. Corporate Transactions
If PROCSD undergoes a corporate transaction including a merger, acquisition, restructuring or sale of assets, information associated with your account may be transferred to the successor or acquiring entity. Any such entity will be required to process personal information in a manner consistent with our Privacy Policy or provide appropriate notice of any material changes.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles. As a consumer in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.
22. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and PROCSD regarding your access to and use of the App.
